Post & Rail USA is a property scouting and media promotion service operated by Penn Kingsley Media. We are not a licensed real estate brokerage or buyer's agency. We do not negotiate transactions, represent buyers or sellers in a sale, or provide legal, financial or investment advice.
2. Scout reports
- Scout reports are informational research compiled from public records, listings and other available sources at the time of preparation.
- While we work hard to be accurate, information such as zoning, HOA rules, land fees and availability can change without notice. You are responsible for independently verifying all material facts before making any purchase decision.
- Package scope (number of properties, inclusions and turnaround) is as described at the time of order or as otherwise agreed in writing.
3. Instagram promotions
- Promotional features on @postandrailusa are advertising placements. Reach, engagement and follower figures are good-faith estimates based on platform analytics and are not guarantees of inquiries, offers or sales.
- You confirm you have the right to promote any property you submit and that all materials supplied are accurate and lawful.
- We reserve the right to decline or remove any feature that doesn't meet our content standards.
4. Payment & refunds
Fees, payment terms and any refund arrangements are confirmed in writing before work begins. Work commences once payment terms are met.
5. Intellectual property
All site content, reports, branding and creative produced by Post & Rail USA remain the property of Penn Kingsley Media unless otherwise agreed. Reports are for the client's personal use and may not be resold or redistributed.
6. Limitation of liability
To the maximum extent permitted by law, Penn Kingsley Media is not liable for any loss arising from reliance on scout report contents or from the performance of promotional placements. Our total liability is limited to the amount paid for the relevant service.
